MOTHER'S DECLARATION --- ARMY PENSION

On this 19th day of August A.D. 1865 personally appeared before me, the probate judge in and for the county and State above named (1) Elizabeth Mummy a resident of (2) Watkins in the county of Union in the State of Ohio she being the age of 54 years, who, being first duly sworn according to the law, doth on her oath, make the following declaration, in order to obtain the benefit of the provisions made by act of Congress approved July 14, 1862: That she is the widow of (3) Solomon Mummy and the mother of Daniel Mummy who was a (4) private in Company (5) "C" commanded by (6) Jess Banning in the (7) 121 Regiment of (8) Ohio Volunteers in the war of 1961, who died (9) on the 19th of March 1865 on the battle field at Bentonville in the State of North Carolina. He was killed in battle by the enemy by gunshot.

She further declares that her said son, upon whom she was wholly or in part dependent for support, having no widow, or minor child under sixteen years of age surviving, declarant makes this application for a pension, under the above-mentioned act, and refers to the evidence filed herewith, and that in the proper department, to establish her claim.

She also declares that she has not, in any way, been engaged in or aided or abetted the rebellion in the United States; that she is not in receipt of a pension under the second section of the act above-mentioned or under any other act, nor has she married since the death of her son, the said Daniel Mummy.

She further declares that she was married to the said (10) Solomon Mummy on the ___ day of August in the year ____; that her husband, the aforesaid Solomon Mummy died on the 17th of April AD 1849. And she further sates that she believes there is no public record of her said marriage and no private record of said marriage, (11) that no public record of marriage was at that time kept of marriage in the State of Pennsylvania. Said marriage took place at the house of Peter Wagner in Green County in the State of Pennsylvania & the marriage was performed by Marshall Eurten, a justice of the peace.

The said Daniel Mummy lived with me at the time he enlisted & gave his entire labor to my support & worked & gave his wages always for my support. He gave his local bounty & his government pay to support me while he was in the army. He sent fifty dollars of his government pay also to me while in the service. I have no land or house & only one cow & two pigs & no other property. I have no other son upon whom I can depend for support.

Her Post Office address is Watkins, Union County Ohio. She makes this declaration for the purpose of obtaining the Pension to which she is entitled by reason of the services and death of her said son. And she hereby constitutes and appoints J. W. Robinson of Marysville Ohio her attorney, with power of substitution, to prosecute the claim and procure a Pension Certificate.

Also, personally appeared before me Jacob S. Huchison and Henry Felkner residents of Watkins Union County Ohio persons whom I certify to respectable and entitled to credit, and who being by me duly sworn, say that they were present and saw Elizabeth Mummy (12) make her mark to the foregoing declaration; and they farther swear that they have every reason to believe, from their knowledge of, and acquaintance with her, that she is the identical person she represents herself to be, that they have no interest in the prosecution of this claim, and they farther say they (13) knew her husband and son to be dead; that they died at the time and place above stated, and that she is still a widow. And they also say that they are acquainted with the circumstances of said Elizabeth Mummy and know them to be as follows: She has no land & no property except a cow & two pigs & a very little household furniture. We also know personally that her said son Daniel Mummy gave his said mother all his earnings before he enlisted in the 121st Regiment of Ohio Volunteers & he gave her his local bounty & has sent her money to support her since he enlisted in said service & that she has no means of support whatever except her own labor and she is not able at her age to earn a living by her labor.
